Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the GudMornin app (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of the App

GudMornin is a mobile application that provides guided morning routine sessions, personalized routine generation, habit tracking, and analytics to help users start their days with intention and focus.

The App offers:

• Free tier — full guided session experience, streak tracking, onboarding, preset and custom routine selection, and local notifications.
• Premium tier — AI-generated personalized routines, unlimited routine customization, advanced analytics (activity grid, duration charts, timing insights, vibe analytics, AI insights), and the “Optimize My Routine” feature.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement.

4. User Account

The App uses Firebase Authentication. You are responsible for maintaining the security of any account credentials. We are not liable for any loss resulting from unauthorized access to your account.

5. Premium Subscription

5.1 Subscription Plans

Premium features are available through a paid subscription managed by Adapty. Subscription plans, pricing, and trial periods are displayed at the time of purchase within the App.

5.2 Free Trial

A free trial period (currently 7 days) may be offered for new subscribers. The trial automatically converts to a paid subscription at the end of the trial period unless cancelled before the trial ends.

5.3 Billing

Subscription fees are billed through the App Store (Apple) or Google Play. Your subscription renews automatically at the end of each billing cycle unless you cancel before the renewal date.

5.4 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.

5.5 Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.

5.6 Price Changes

We reserve the right to change subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree not to:

• reverse-engineer, decompile, or disassemble the App;
• use the App for any unlawful purpose;
• attempt to gain unauthorized access to any part of the App or its backend services;
• use automated systems to access or scrape the App;
• interfere with the proper functioning of the App or its servers.

7. Intellectual Property

All content, design, code, and assets within the App are owned by or licensed to Fatih Demir. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Nothing in these Terms grants you ownership of any App content or intellectual property.

8. User-Generated Content

Content you create within the App (routine notes, journal entries, reflections) is stored locally on your device. We do not claim ownership of your content.

9. Third-Party Services

The App integrates with the following third-party services, each governed by their own terms:

We are not responsible for the practices, content, or availability of third-party services.

10. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

The App is not a medical or mental health service. Content and guided sessions are for informational and motivational purposes only. Consult a qualified professional for medical, psychological, or health-related advice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Fatih Demir shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim, or $10 USD if you have not paid anything.

12. Indemnification

You agree to indemnify and hold harmless Fatih Demir from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

13. Modifications to the App or Terms

We reserve the right to modify, suspend, or discontinue any part of the App at any time. We may also update these Terms periodically. Continued use of the App after any modification constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes.

14. Termination

We reserve the right to suspend or terminate your access to the App for violations of these Terms. You may stop using the App at any time by deleting it from your device.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Turkey.
